1. About These Terms

These Terms & Conditions ("Terms") govern your use of vitalprime.ca (the "Site") and, where applicable, your purchase and use of products offered by PRIME VITAL CORP., an Ontario corporation operating under the VITAL PRIME brand ("VITAL PRIME," "we," "us," or "our"). Purchases through Amazon.ca or another marketplace are also subject to that marketplace's applicable terms.

2. About VITAL PRIME

VITAL PRIME is a Canadian-owned and operated brand of PRIME VITAL CORP., an Ontario corporation. Our products are selected and developed for the Canadian market and are intended to provide practical, convenient solutions for everyday personal-care routines.

3. Canadian Brand and Product Origin

VITAL PRIME is a Canadian-owned and operated brand of PRIME VITAL CORP., based in Ontario, Canada. Our brand development, product selection, customer experience, and Canadian-market requirements are managed in Canada. Unless a particular product expressly states otherwise, VITAL PRIME products should not be understood to be manufactured in Canada. The VITAL PRIME Ultrasonic Cleaner is manufactured in China for VITAL PRIME. Country-of-origin information appearing on the product, packaging, user manual, or applicable product listing forms part of this disclosure. References to VITAL PRIME as "Canadian," "Canadian-owned," "Canadian-operated," or "Proudly Canadian" describe the company and brand and are not intended as a representation that the product itself is "Made in Canada" or a "Product of Canada."

4. Product Information

We make reasonable efforts to ensure product descriptions, specifications, photographs, instructions, prices, and other information are accurate. Actual appearance, packaging, accessories, specifications, or colours may vary slightly. We may update product specifications, packaging, content, or features, subject to applicable law.

5. VITAL PRIME Ultrasonic Cleaner

The VITAL PRIME Ultrasonic Cleaner is intended to assist with routine cleaning of compatible oral appliances such as aligners, retainers, mouth guards, dentures, and night guards, subject to product instructions and compatibility recommendations. Users must also follow care instructions from the manufacturer or dental professional responsible for their particular oral appliance.

6. Important Product and Health Disclaimer

VITAL PRIME products are consumer wellness and personal-care products unless expressly stated otherwise. The VITAL PRIME Ultrasonic Cleaner does not diagnose, treat, cure, or prevent disease and is not a substitute for professional dental or medical care. Product information is for general information and product-use purposes and does not constitute medical, dental, diagnostic, or therapeutic advice.

7. Proper Use

Products must be used only for their intended purposes and in accordance with supplied instructions. Before cleaning an oral appliance, confirm that it is compatible with ultrasonic cleaning and follow instructions from its manufacturer or appropriate dental professional.

8. Availability, Orders and Marketplace Purchases

Products are subject to availability. Purchases through Amazon.ca or another marketplace may have order acceptance, payment processing, fulfillment, shipping, delivery, returns, and refunds administered by that marketplace under its applicable policies.

9. Direct Purchases

If VITAL PRIME enables direct purchases through vitalprime.ca, price, taxes, shipping charges, payment terms, delivery information, and other charges will be disclosed before order submission.

10. Prices and Promotions

Unless otherwise indicated, Canadian prices are in Canadian dollars. Prices, promotions, coupons, and discounts may change and may be subject to eligibility, expiry, inventory, redemption limits, and additional disclosed terms.

11. Shipping and Delivery

For direct sales, shipping methods, costs, estimated delivery times, and geographic restrictions will be disclosed at checkout or in the applicable shipping policy. Delivery estimates are not guarantees. Marketplace purchases are subject to marketplace fulfillment procedures.

12. Returns and Refunds

Returns and refunds for marketplace purchases are generally processed under that marketplace's applicable policies. For direct purchases, the return and refund policy displayed on vitalprime.ca at the time of purchase will apply. Nothing in these Terms limits non-waivable consumer rights or remedies under applicable law.

13. Limited 12-Month Manufacturing Defects Warranty

VITAL PRIME provides a limited 12-month warranty from the original date of purchase for the VITAL PRIME Ultrasonic Cleaner. This warranty expressly covers manufacturing defects, including defects in materials or workmanship attributable to the manufacturing process that arise under normal and intended use.

This voluntary limited warranty does not cover normal wear and tear; cosmetic damage that does not affect function; accidental damage; intentional or deliberate damage caused by the purchaser, user, or any third party; misuse, abuse, neglect, improper storage or maintenance; use contrary to the user manual; use with incompatible items, liquids, or substances; unauthorized modification, disassembly, or repair; damage caused by external events or improper power supply; or any condition not attributable to a manufacturing defect.

To make a warranty claim, the purchaser must contact support@vitalprime.ca and provide reasonable proof of purchase and information reasonably required to assess the claimed manufacturing defect, which may include photographs or video. If a claim is accepted, VITAL PRIME may, at its option and subject to applicable law, repair the product, replace it with the same or a comparable product, or provide another remedy required by applicable law.

This limited warranty is in addition to, and does not replace, restrict, or exclude, rights or remedies that cannot lawfully be excluded under applicable consumer-protection legislation.

14. Intellectual Property

The Site and its content, including the VITAL PRIME name, logos, trademarks, designs, photographs, videos, graphics, written content, and product presentation, are owned by or licensed to PRIME VITAL CORP. and protected by applicable intellectual-property laws.

15. Reviews, Social Media and User Content

If you voluntarily submit a review, photograph, video, testimonial, comment, or other content, you represent that you have the right to provide it. Promotional use will be limited to permissions you provide or uses otherwise permitted by applicable law and platform terms.

16. Acceptable Use

You must not use the Site for unlawful or fraudulent purposes; attempt unauthorized access; introduce malicious code; interfere with Site operation; scrape content for unauthorized commercial purposes; impersonate another person; or infringe intellectual-property or privacy rights.

17. Third-Party Websites and Services

The Site may link to Amazon, social media, payment services, or other third-party websites. These services are independently operated and their own terms and privacy policies apply.

18. Disclaimer and Limitation of Liability

To the extent permitted by applicable law, the Site and its content are provided on an "as available" basis. VITAL PRIME does not guarantee uninterrupted or error-free access. Nothing in these Terms excludes or limits liability, rights, warranties, or remedies that cannot lawfully be excluded or limited.

19. Indemnification

To the extent permitted by law, you agree to be responsible for losses reasonably arising from your unlawful use of the Site, violation of these Terms, or infringement of another person's rights.

20. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

21. Changes to These Terms

We may update these Terms periodically. The Terms applicable to a transaction will be those in effect at the relevant time, subject to applicable law.

22. Governing Law

These Terms are governed by the laws applicable in the Province of Ontario and the federal laws of Canada applicable therein, without limiting mandatory consumer rights that may apply based on your place of residence.
